OPTIONS AVAILABLE TO DEFUSE TENSIONS ON THE SAFETY AND SECURITY OF THE UP, PUP CAMPUSES, COMMUNITY
As UP alumnus, I suggest various alternatives to defuse tensions arising from the Department of National Defense abrogation of a security pact with the University of the Philippines and similar possible actions as regards the Polytechnic University of the Philippines.
There are two sets of options: mediation and court intervention. Both sets can move forward simultaneously or one followed by the other.
Mediation Options:
· Commission on Higher Education
· Joint Congressional Oversight Committee
· Special Ad Hoc Committee
Go to Court Options:
· Temporary Restraining Order (to maintain status quo prior to unilateral abrogation)
· Temporary Protection Order (preemptive action against possible threats)
· Permanent Writ of Amparo (long term injunction to protect the campuses)
· Writ of Habeas Data (specific protection on privacy of communications and data)
On its own, the CHED has intervened. I commend the CHED on this.
However, if CHED efforts fail, I suggest Congress intervene and create a special ad hoc committee.
If mediation fails or while mediation is underway, a TRO could be sought so the mediation can proceed.
Depending on the security or safety threat levels the campus community members face, that’s what the temporary protection order, permanent writ of Amparo, and writ of habeas data would be for. (END)
